Terms of Use

These Terms of Use ("Terms") govern the use of the Caranguejo.art platform ("Caranguejo", "we"), operated by an individual based in Brazil. By creating an account, signing in (including via Google OAuth), subscribing to a plan, purchasing credits or using any feature, you declare that you have read, understood and fully agree to these Terms and to our Privacy Policy.

If you disagree with any part, do not use the service. If you use it on behalf of a company, you declare you have authority to bind it to these Terms.

To use the service you need an account — via email/password or Google OAuth 2.0. By creating an account you declare that:

• You are 16 or older. Users under 16 are prohibited.

• Information provided is true, complete and up to date.

• You are solely responsible for keeping your password confidential and for all activity in your account.

• You will not share credentials with third parties — one account per person.

• You will immediately notify support in case of unauthorized use of your account.

We reserve the right to refuse or cancel accounts that violate these Terms, without prior notice in serious cases.

Caranguejo is a creative platform offering unified access to multiple generative AI models for image, video, audio and text, operated by third parties (see section Dependency on External Providers). We provide:

• Image generation (text-to-image, image-edit, image-variations, image-to-image).

• Video generation (text-to-video, image-to-video, motion-control, edit).

• Audio generation (music, voice, sound effects, dubbing).

• Tools (upscale, remove background, camera angle, restyle, relight, inpaint, enhance).

• Marketing Studio (video ad generation from product photo + scene description).

• Flow (visual workflows chaining models).

• Community (public gallery of creations).

• Chat system with language models.

Access to models is charged via credit consumption. You acquire credits via:

• Monthly or annual subscription — each plan (Free, Standard, Pro, Business) provides creditsPerMonth renewed at the start of each cycle.

• One-off packs (top-ups) — non-recurring credits added to the subscription balance.

• Promotions and coupons — occasional bonus credits, no guarantee of continuity.

Credit cost per generation depends on the model and parameters (duration, resolution, iterations). The price is shown in the UI before you confirm the generation — no surprise charges.

Payments are processed by Stripe. Prices may be shown in BRL or USD depending on your location. Applicable taxes are calculated by Stripe and added to the final price when required by law.

Subscriptions renew automatically at the end of each cycle until you cancel. Cancellation can be done at any time via /billing or /account and takes effect at the end of the current cycle.

To ensure balanced availability, all generation jobs go through a priority queue system defined by plan:

• Free — standard queue, low priority. Concurrency limited to 1 job at a time.

• Standard — normal priority, higher concurrency (more than 1 simultaneous job).

• Pro — high priority, higher concurrency, jumps ahead of Free and Standard.

• Business — maximum priority, maximum concurrency, served first.

Wait times vary with demand and provider capacity — at peak times, even higher plans may queue. The dispatcher serializes jobs respecting each plan's concurrency limits and each provider's API capacity.

You can track your queue position in real time during generation.

Each generation executed on Caranguejo is processed by a third-party API — the provider that operates the model you selected. The current list of providers includes (non-exhaustive):

Implications you acknowledge and accept:

• Variable latency: generation time depends entirely on the provider. Demand spikes, maintenance, or provider infrastructure changes affect response times.

• Availability: if a provider goes down, related models become temporarily unavailable. We show status in the UI when we detect failures.

• Quality: output quality depends on the chosen model and provider. We do not guarantee specific results — generative AI is probabilistic.

• Behavior changes: providers may update their models without notice, changing style, capability or usage policy.

• Provider usage policy: each provider applies its own content filters. Generation may be refused for moderation reasons independent of our Terms.

We are not responsible for degradation, outage, behavior changes, generation refusals or any other act or omission of providers. When a job fails due to provider issues (timeout, upstream error, moderation refusal escaping our pre-filter), credits charged are automatically refunded to your balance.

All payments are processed by Stripe, Inc. — we do not store card number, CVV or full banking details. Accepted methods follow Stripe's availability in your region (credit card, debit, Pix in BRL when available).

Subscription renewal is automatic until explicit cancellation. In case of payment failure (expired card, insufficient funds, chargeback), the subscription may be suspended after Stripe's configured retry count.

Receipts are sent via email after each successful charge and are accessible at /billing.

Base rule: we refund only the unused credit balance, and only within a specific window.

8.1 Subscription cancellation

• You may cancel your subscription at any time — it takes effect at the end of the current cycle.

• You retain access until the end of the period already paid for.

• No retroactive refund of already-consumed months. Credits for the current month remain available until cycle rollover.

8.2 Proportional credit refund (7-day window)

• Window: you have 7 calendar days from the date of purchase to request a refund.

• Calculation basis: credits. We refund the portion proportional to the credit balance not yet consumed. Formula: refund = amount_paid × (credits_unused / credits_purchased).

• Practical example: you bought a 1,000-credit pack for US$100. You used 500 credits. Requested refund within 7 days. Refund = US$100 × (500 / 1000) = US$50.

8.3 After 7 days

• No cash refund.

• Unused credits remain valid while the account is active (subject to the inactivity policy described in Inactive account).

8.4 Refund denied

• In case of fraudulent use, multi-accounting, abuse or violation of these Terms.

• When the reason is subjective dissatisfaction with the AI output — AI is probabilistic and this is shown prominently before purchase.

• In case of undue chargeback (we will dispute with the operator and apply Abuse detection).

8.5 How to request

Send an email to [email protected] from the same address as the account, including: purchase id (found in /billing), reason, and how many credits were consumed. We respond within 5 business days. Approvals are credited by Stripe to the original payment method within 10 business days (varies by card issuer).

You own the content you generate — images, videos, audios and texts produced from your prompts and inputs, within the limits of applicable law and the terms of the underlying providers (some models have specific clauses on commercial use — check the model page).

By generating content on the platform, you grant us a non-exclusive, worldwide, royalty-free and revocable license to:

• Store and display the content in your account (service operation).

• Display the content in the public community gallery only if you actively publish (publishing is opt-in per job; generations are private by default).

• Use anonymized samples in platform marketing material only with your express case-by-case consent.

We do not train our own models on your creations without explicit consent. When your content is sent to a provider for generation, that provider may have its own retention/training policies — check the provider's terms.

You are responsible for ensuring you have rights to the inputs you send (reference images, voices, prompts), and that using the output does not violate third-party rights.

You may NOT use the platform to:

• Child sexual abuse material (CSAM), content that sexualizes minors, or any content involving minors in sexualized contexts — severe violation; we apply immediate suspension and report to authorities.

• Non-consensual sexual / nude content of identifiable real persons (deepfake porn). It is prohibited to create sexual or nude content using the face, voice or recognizable identity of a real person without documented express consent.

• Content that violates third-party copyright or IP — including replicating styles of protected works for commercial use without license.

• Content promoting real-world violence, terrorism, criminal organizations, hate speech (racism, xenophobia, homophobia, transphobia, antisemitism, ableism, religious intolerance), or that incites harm to individuals or groups.

• Election disinformation, fraud or impersonation of public figures in contexts that may mislead the public about authenticity.

• Attempts to extract, copy or reverse-engineer models, system prompts, infrastructure, or to exploit vulnerabilities.

• Multiple accounts (multi-accounting) to bypass credit limits, free plans or suspensions.

• Credential sharing — login is personal and non-transferable.

• Bots, scrapers or unauthorized automation of the interface or endpoints — you may only automate via official APIs when available and with explicit permission.

• Fraudulent chargeback — disputing legitimate already-consumed payment constitutes fraud and may be subject to civil and criminal action.

• Deliberate overload of queues, denial-of-service, port scanning or any infrastructure attack.

• Illegal activities under Brazilian law or the law of your country of residence.

We monitor usage patterns to detect abuse, fraud and violations of these Terms. Indicators that may trigger review:

• Atypical job spikes in a short interval.

• Multiple accounts on the same IP, device or payment card.

• Recurring chargeback pattern after use.

• Repeated generation of content blocked by filters.

• Reports from other users ("Report" button on each post).

Actions we may take:

• Temporary suspension of the account for investigation (typically up to 7 days).

• Blocking specific features (e.g. community, marketing studio) without suspending login.

• Permanent termination of the account in case of confirmed violation — no refund when the cause is violation of these Terms.

• Reporting to authorities in cases provided by law (especially CSAM and financial fraud).

Decisions can be appealed via [email protected] with arguments and evidence — we review manually.

Anyone may report content

Each post published to the community has a "Report" button that triggers moderation review. Categories: non-consensual nudity, IP infringement, hate speech, spam, other.

Copyright complaints

For copyright complaints (Brazilian DMCA-style), send an email to [email protected] containing:

• Full identification of the rights holder (name, ID, address, contact).

• Description of the protected work and proof of ownership (e.g. registration, contract, evidence of authorship).

• Exact location of the infringing content on the platform (URL or post id).

• Signed good-faith statement that the use is not authorized.

• Statement under penalty of perjury that the information is accurate.

We evaluate and remove valid content within 7 business days. The affected user is notified and has the right to counter-notice. Repeat infringers have their account suspended.

Summary: accounts without an active subscription and with no login for 90 or more days may have generated media, elements and Flow projects permanently deleted. The account itself is retained to preserve financial history and prevent fraudulent email reuse.

Process:

1. We detect the account as inactive (90+ days without login, no active subscription).

2. We send an email notice 30 days in advance indicating: the scheduled deletion date, the volume of data to be deleted, and how to reactivate (just log in).

3. If you log in or subscribe within those 30 days, deletion is cancelled.

4. Otherwise, on the scheduled date, generated media, elements and Flow projects are deleted.

What is NOT deleted: account data (email, name), financial transaction history (tax obligation), audit logs.

How to avoid: logging in every 90 days is enough. Keeping an active subscription also preserves everything automatically.

14.1 Termination by you

You may terminate your account at any time via /account ("Close account" section) or by emailing us. Termination implies:

• Subscription cancellation at the end of the current cycle.

• Application of the refund policy (Refund) if within the applicable window.

• Deletion of media, elements and flows within 30 days (we preserve financial data per tax obligation).

14.2 Termination by us

We may suspend or terminate your account:

• Immediately, without notice — in case of severe violation (CSAM, confirmed financial fraud, infrastructure attack, clearly illegal content). No right to refund.

• With 7 days' notice to remedy — in case of non-severe violation (e.g. 3rd valid report, detected multi-accounting). If remedied, the suspension is reversed.

• With 30 days' notice — in case of service discontinuation or structural change that makes your account incompatible.

The service is provided "as is". We do not guarantee:

• Uninterrupted availability — scheduled maintenance and provider outages may occur.

• That the output will serve a specific purpose — generative AI is probabilistic.

• That the service is free of errors, bugs or vulnerabilities.

• Specific commercial outcomes for your projects.

Liability cap: to the maximum extent permitted by law, our total aggregate liability for any claim related to the service shall not exceed the amount you paid in the 12 months prior to the event giving rise to the claim. We are not liable for indirect damages, lost profits, loss of data or opportunity.

Exceptions: this limitation does not apply to cases of willful misconduct, fraud or instances where the law forbids contractual limitation.

You agree to indemnify and hold harmless Caranguejo, its operators, partners and providers from any claim, damage, loss, cost or expense (including attorney fees) arising from:

• Your use of the platform in violation of these Terms.

• Content you generate, upload or share.

• Violation of third-party rights (copyright, image, voice, trademark, privacy).

• Illegal activities committed via your account.

These Terms are governed by the laws of the Federative Republic of Brazil. The forum of the operator's domicile is elected to resolve any disputes, save where consumer law sets a different forum (CDC).

Out-of-court mediation and arbitration are welcome before judicial action — we recommend direct contact via [email protected] for an attempt at agreement.

We may update these Terms to reflect changes in the service, the law or our providers. Material changes (which expand your obligations or significantly reduce your rights) are notified 30 days in advance via email and an in-app banner. Wording changes, corrections or non-material adjustments take effect upon publication. The date of the last update appears at the top of this page.

If you disagree with changes, you must cancel the account before the effective date. Continued use after the effective date implies agreement with the updated version.
